Candidate Terms of Service

These Candidate Terms of Service (the “Candidate Terms”) describe your rights and responsibilities when using our online tools and platform (the “Services”). Please read them carefully.

If you are a Candidate or an Account Creator, these Candidate Terms govern your access and use of our Services. In these Candidate Terms, “you” refers to the Candidate and/or the Account Creator, as the case may be.

These Candidate Terms shall govern your use of our website.

By using our website, you are deemed to have accepted these Candidate Terms in full; accordingly, if you disagree with these Candidate Terms or any part of these Candidate Terms, you must not use our website.

You must be at least 18 years of age to use our website; by using our website or agreeing to these Candidate Terms, you warrant and represent to us that you are at least 18 years of age.

Our website uses cookies; by using our website or agreeing to these Candidate Terms, you consent to our use of cookies in accordance with the terms of our privacy policy.

1. Definitions

Candidate” means any individual person who is the subject of a Candidate account on the Martide website, whether such profile or account is created (i) directly by the individual, or (ii) on the individual’s behalf by an authorised third party (including but not limited to a recruitment agent, employer, or other intermediary) acting with the individual’s prior consent.

Account Creator” means any person other than the Candidate who creates or manages a Candidate account on the Candidate’s behalf.

2. Services

Through our website, we provide an online platform through which Candidates (or Account Creators) may create and manage personal profiles, upload and store professional details, seafaring qualifications, and supporting documents.

We provide the following services:

  1. Vacancy Matching and Applications
    Our platform enables Candidates to view and apply for vacancies posted by employers or manning agents.

  2. Communication Tools
    Our platform facilitates communications between Candidates, employers, and manning agents, including the transmission of applications, messages, and documentation. Where requested by employers or required by applicable standards, our platform may provide tools for uploading, verifying, and sharing certificates, licences, or other documents relevant to seafarer recruitment.

  3. Recruitment and Placement Facilitation
    Our platform provides functionality to support the recruitment and placement process, including contract generation tools, but Martide does not itself employ seafarers.

  4. Additional Features
    Martide may from time to time offer additional features, such as notifications of opportunities, reminders, or analytics, designed to improve the Candidate experience.

Martide provides the platform as a facilitation and communication service only. Martide is not the employer of any Candidate, does not guarantee placement, and unless expressly agreed in writing, does not act as a recruitment or placement agency within the meaning of the Maritime Labour Convention or any local employment laws. Employment contracts, wages, benefits, and working conditions are solely the responsibility of the employer or manning agent.

3. Authorised Creation of Candidate Account; Verification of Candidate

Only the Candidate or an Account Creator acting with the Candidate’s prior express consent may create a Candidate account.

The Account Creator warrants that:

  1. the Candidate has authorised submission of all personal data, documents, and credentials to Martide to be reflected on the Martide website;
  2. the Candidate has agreed to be bound by these Candidate Terms and Martide’s Privacy Policy; and
  3. the Candidate is at least 18 years of age at the time of account creation, and the Account Creator has taken reasonable steps to verify this.

Within five (5) days of the creation of the Candidate account, Martide will notify the Candidate (via the email which is provided upon the creation of the Candidate account) that a profile has been created in their name and provide a link for the Candidate to (i) confirm their consent to the creation of the Candidate account, (ii) view the information recorded by Martide and correct the information, or (iii) object to the creation of the Candidate account. If the Candidate fails to confirm or objects within fourteen (14) days, Martide may suspend or delete the account.

Martide is under no obligation to retain unverified account data beyond applicable legal retention periods.

Martide may, in its discretion, require identity verification or additional documentation before enabling the account for full use.

4. Candidate Rights

The Candidate is the beneficial owner of all rights associated with the Candidate account.

The Candidate may, at any time, request control of their account, including changing login credentials, modifying or removing data, or deleting the account.

The Account Creator must not impede these rights and must relinquish access upon the Candidate’s request.

5. Accuracy of Information

You acknowledge that we may share your information with employers or manning agents for the purpose of performing crewing services.

The Candidate and/or Account Creator must ensure that all information submitted is accurate, complete, and kept up to date.

Martide may suspend or remove any account containing false, misleading, or outdated information.

6. Data and Privacy

Candidate data will be collected, used, stored, and disclosed in accordance with Martide’s Privacy Policy.

7. Termination

Martide may suspend or terminate any Candidate account at any time where:

(a) information is false, misleading, or submitted without authority;

(b) the Candidate or Account Creator breaches these Terms; or

(c) continued account operation would expose Martide to legal or reputational risk.

8. Copyright Notice

Subject to the express provisions of these Candidate Terms: (a) we, together with our licensors, own and control all the copyright and other intellectual property rights in our website and the material on our website (including material you may have submitted to us); and (b) all the copyright and other intellectual property rights in our website and the material on our website are reserved.

9. Licence to Use Website

You may: (a) view pages from our website in a web browser; (b) download pages from our website for caching in a web browser; (c) print pages from our website; (d) stream audio and video files from our website; and (e) use our website services by means of a web browser, subject to the other provisions of these terms and conditions.

Except as expressly permitted in these Candidate Terms, you must not download any material from our website or save any such material to your computer.

You may only use our website for your own personal and business purposes, and you must not use our website for any other purposes.

Except as expressly permitted by these Candidate Terms, you must not edit or otherwise modify any material on our website.

Unless you own or control the relevant rights in the material, you must not: (a) republish material from our website (including republication on another website); (b) sell, rent or sub-license material from our website; (c) show any material from our website in public; (d) exploit material from our website for a commercial purpose; or (e) redistribute material from our website.

Notwithstanding the sub-section above, you may redistribute our newsletter in electronic form to any person.

We reserve the right to restrict access to areas of our website, or indeed our whole website, at our discretion; you must not circumvent or bypass, or attempt to circumvent or bypass, any access restriction measures on our website.

10. Acceptable Use

You must not: (a) use our website in any way or take any action that causes, or may cause, damage to the website or impairment of the performance, availability or accessibility of the website; (b) use our website in any way that is unlawful, illegal, fraudulent or harmful, or in connection with any unlawful, illegal, fraudulent or harmful purpose or activity; (c) use our website to copy, store, host, transmit, send, use, publish or distribute any material which consists of (or is linked to) any spyware, computer virus, Trojan horse, worm, keystroke logger, rootkit or other malicious computer software; (d) conduct any systematic or automated data collection activities (including without limitation scraping, data mining, data extraction and data harvesting) on or in relation to our website without our express written consent; (e) access or otherwise interact with our website using any robot, spider or other automated means, except for the purpose of search engine indexing; (f) violate the directives set out in the robots.txt files for our website; or (g) use data collected from our website for any direct marketing activity (including without limitation email marketing, SMS marketing, telemarketing and direct mailing).

You must not use data collected from our website to contact individuals, companies or other persons or entities.

You must ensure that all the information you supply to us through our website, or in relation to our website, is true, accurate, current, complete and non-misleading.

11. Use on Behalf of Organisation

If you use our website or expressly agree to these Candidate Terms in the course of a business, then by so doing you bind both: (a) yourself; and (b) the person, company or other legal entity that operates that business, to these Candidate Terms, and in these circumstances references to “you” in these Candidate Terms are to both the individual user and the relevant person, company or legal entity.

12. Governing Law and Dispute Resolution

These Candidate Terms shall be governed by the laws of Singapore.

Any dispute arising out of or in connection with these Candidate Terms, including any question regarding its existence, validity or termination, shall be referred to and finally resolved by arbitration administered by the Singapore International Arbitration Centre (“SIAC”) in accordance with the Arbitration Rules of the Singapore International Arbitration Centre (“SIAC Rules”) for the time being in force, which rules are deemed to be incorporated by reference in this clause. The seat of the arbitration shall be Singapore. The Tribunal shall consist of one arbitrator. The language of the arbitration shall be English. The law governing this arbitration agreement shall be Singapore law.

Nothing in this clause shall preclude Martide from seeking injunctive or equitable relief in any court of competent jurisdiction to protect its intellectual property or confidential information.
